RED DA – EC consultation on the entry into application of the RED Delegated Regulation 2022/30

On 24th May, the European Commission launched a public consultation on the extension of the application date of the Delegated Regulation (EU) 2022/30 on cybersecurity aspects supplementing the Radio Equipment Directive (RED DA), currently foreseen as of 1st August 2024. 

The consultation will be open for feedback for 4 weeks and interested stakeholders are invited to provide their input until 21st June 2023.  

In particular, the Commission is collecting feedback on a draft delegated regulation amending the RED Delegated Regulation (EU) 2022/30 in order to defer the application of its provisions and correct an error. The aim is to ensure that European Standard Organisations (ESOs) will have sufficient time to draft the new harmonised standards in support of Article 3(3), second subparagraph, points (d), (e) and (f) of the RED, for the classes and categories of radio equipment specified by the RED DA on cybersecurity aspects.  

The initiative follows the request of the European Standardisation Organisations (ESOs) to delay the initial schedule of the RED DA. Hence, CEN and CENELEC asked for the extension of the deadline for the delivery of harmonised standards by nine months, together with the date of applicability of the RED Delegated Regulation delayed by twelve months. According to the draft regulation under consultation, the RED DA will therefore start applying from 1st August 2025.  

CECE welcomes the proposed amendment to the RED DA and believes the postponement of the application timeframe is crucial for construction equipment manufacturers. This will provide the industry with adequate time to redesign and adapt their products in accordance with the available harmonised standards. In addition, the extension will allow manufacturers to complete the appropriate conformity assessment procedure before the Delegated Act becomes applicable. 

CECE will monitor the development of the legislative process and contribute to the initiative by submitting its positive feedback to the European Commission.
