The ‘Goods package’ – market surveillance proposal under assessment
In December 2017 the European Commission published a ‘Goods package’ on market surveillance, including a proposal for a ‘Regulation on compliance and enforcement of EU harmonisation legislation’ COM(2017)795 and a ‘Proposal for a Regulation on the mutual recognition of goods lawfully marketed in another Member State’ COM (2017)796.
In the past years, capital goods manufactured by the machinery industry have suffered from a lack of focus in the enforcement process, therefore CECE welcomes the EU Commission initiative being aware that an efficient market surveillance in Europe is essential to fight unfair competition caused by the entry and circulation of non-compliant products.
CECE believes that enhance cooperation between manufactures and national authorities is crucial for a more efficient surveillance system. On this point, the package includes mechanisms for compliance information, compliance partnership agreements and memoranda of understanding. New mechanisms have been introduced also to improve members states coordination as liaison offices, market surveillance indicators and product compliance network. Similarly, the development of more performance ties between market surveillance and border control is one of the positive points of the proposal. However, the new package should not add complexity on the placing on the market process or related compliance information for manufacturers, especially for SMEs.
At the end of January 2018, MEP Nicola Danti (S&D, IT) was appointed rapporteur of the Regulation on compliance and enforcement and MEP Ivan Stefanec (EPP, SK) will be the rapporteur for the Regulation on mutual recognition. The draft Regulations will now be sent to the European Parliament and Council for adoption. CECE will follow the file closely to secure that the construction machinery manufactures are part of the debate.
